In the 1980s there was a lot of discussion about whether monitoring special conditions should be a probation task, and whether this can be combined with offering help and assistance. The authors show that this discussion has been settled by introducing a specific knowledge base for probation work. They outline a number of important developments in recent decades: the focus on risk and the enforced framework, and the great influence of new technology. Nevertheless, an important basis for probation remains unchanged: the quality of the contact between probation officer and client. |

In 1985 the Second International Congress on (Prison) Abolitionism took place. The organizers wanted to denounce the formalistic-legal approach to crime and revise the criminal pretensions. The aim was to develop a non-repressive process of conflict regulation. This contribution addresses the question of whether or to what extent the development of restorative justice in recent decades is an extension of the abolitionist perspective. Among other things, the developments in punishment and restorative detention and restorative justice in The Netherlands are discussed. It is concluded that restorative justice in a broad sense- and the introduction of small-scale, tailor-made detention are a realistic, at this time appropriate continuation of the efforts to find solutions for resolving conflicts outside criminal law. |

For this anniversary issue of the centenary of the journal PROCES, we focused on the field of forensic psychiatry. What does one hundred years of PROCES tell us about the developments in this domain? Our starting point was an article from 1930. At that time, forensic psychiatry was not yet an integrated part of the criminal process. The anonymous author makes a plea for this to be the case. He substantiates this on the basis of four cases from his own practice. Now, one hundred years later, we conclude that this integration of forensic psychiatry into the criminal justice practice has been accomplished: there is ample attention to the mental health of suspects and detainees. The cases also show us how drastically the perspective on delinquents with a mental condition has changed, as a suspect suffering from a mental disorder was seen, by definition, as not criminally responsible. Reviewing the developments of the past hundred years has made us realize how temporary and transient our current perspective is. We are, however, convinced that the interest in individual motives of delinquents will always remain. |

The authors have taken a contribution from Frank Bovenkerk from 2003 as a starting point. In this text, Bovenkerk reflects on taboos in criminology. In science, in addition to independence, focus on truth-finding, a willingness to self-correct and organized skepticism, courage is also an important quality. Where Bovenkerk focuses more broadly on criminology, this contribution focuses in particular on taboos and requirements for scientists in police research. |

In 1981, PROCES published its first article on the criminal justice system in a pluriform or multicultural society. That article turned out to be the first of many articles on so-called cultural offences, like honour related violence and female genital mutilation, and the ways in which the criminal justice system could and should respond to these offences. This article reviews the various articles written on these topics for the past forty years and tries to finds an answer why it was that authors choose PROCES to publish their articles. |

Over hervorming in het gevangeniswezen |
Trefwoorden | prison reform, solitary confinement, Rehabilitation, detention regime |
Auteurs | Mr. dr. Sigrid van Wingerden |
SamenvattingAuteursinformatie |
In 1922 Honing gave a speech for the Society for the Moral Improvement of Prisoners, in which he advocated renewal in the prison system: for the sake of rehabilitation the system of solitary confinement should be replaced by a prison system in which prisoners actually share facilities and live together. His proposal for reform is theory driven and accompanied by a plan to experiment with the joint confinement before implementing it. This is in sharp contrast with contemporary prison reforms, which impair the possibilities for rehabilitation of prisoners. |

SamenvattingAuteursinformatie |
In 1932 the court room of the Juvenile Judge in Amsterdam was redesigned and this work was marked as 'spadework'. In 2021 in a joined project of law student and art students ‘Design of Justice’ a concept for a court room of the future is developed. Again 'spadework'? In this article the author reflects on this and other current developments in the field child-friendly justice in criminal youth cases. |
