Legal change is likely to be the product of a complicated process involving many actors. Law making in international organisations and national legislatures are obvious examples. However, legal change sometimes appears to have resulted from the efforts of an individual actor. Against the odds, his or her new ideas win the day in a legal arena, changing the course of legal development. This special issue samples some of these cases, with examples from various legal arenas, such as an international organisation, national legislatures, a supreme court and a law school. The authors reconstruct the history of their case, examining whether the actors have indeed played a key role in the legal change considered, under what conditions they were able to do this and what remained of their efforts in legal practice. |

The 2007 Dutch Pardon Regulation, a regularisation programme to settle the legacy of the old immigration law, was meant to deal with backlogs in the settling of asylum procedures. According to the literature there are several risks attached to such regularisation programmes. The parties involved in the implementation of the Dutch Pardon Regulation managed to evade most of these risks, partly because of their great efforts and close cooperation. The results of the Regulation were according to plan with respect to the number of asylum seekers who received a permit in the context of the regulation and their housing. In two respects the Regulation did not have the desired result: temporary shelter in municipalities decreased but was not ended, and it proved difficult to carry through the return of people who were ineligible for the regularisation programme. |

Several reports covering the provision of legal aid in asylum procedures in a selection of European countries expressed concerns on the effectiveness of the legal aid provided to asylum seekers. Among others, the cuts in legal aid funding and the speed of the asylum process were put forward as issues affecting the provision of adequate and effective legal aid. Lawyers providing legal aid in asylum procedure have to cope with the day-to-day realities arising from the national asylum procedure and legal aid system in which they operate. The aim of my research project is to explore and understand the impact of the institutional context, i.e. the functioning of the asylum procedure and the legal aid system on lawyers’ conduct. To this end I will conduct a comparative case study in three EU Member States which have arranged for the provision of legal aid in different ways, i.e. Netherlands, the United Kingdom1xHere it must be noted that the UK comprises of four constituent countries with different regimes.
